These Terms of Use (the "Terms") govern your access to and use of Tambu (the "app"), a mobile application that helps users organize their music practice sessions and manage a library of practice items.

Please read these Terms carefully before using the app. By creating an account or accessing Tambu, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use Tambu.

Tambu is intended for users who are at least 13 years old. If you are under 13, you are not permitted to create an account or use the app. By using Tambu, you confirm that you are at least 13 years old.

To use Tambu, you must create an account by providing your email address and date of birth. You may also sign up using a third-party account (e.g., Google or Apple). If you do so, you authorize Tambu to collect your email address from the third-party account, and to use such third-party credentials to log you into your account.

By registering, you agree to provide true, accurate, current and complete information about yourself (for example, your date of birth). If we have reasonable grounds to suspect that you have provided inaccurate information (for example, a false date of birth), we have the right to suspend or terminate your account and refuse any current or future use.

You agree to create an account for your own personal, non-commercial use and not share your account or subscription with others. You are responsible for maintaining the confidentiality of your login information and any activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account by emailing us at hello@tambu.fm.

Your use of Tambu is subject to our Privacy Policy, which explains how we collect, store, and process your personal data. This includes:

• Your email address and date of birth during account creation.

• Practice data, such as practice session details, durations, notes, and any media you upload (e.g., audio recordings, images, or documents).

• Feedback submitted via the app.

Some of this data (such as your account details and practice data) is essential to providing the core functionality of Tambu, while other data (like your feedback) helps us improve your experience of using the app. We strongly encourage you to review our Privacy Policy to fully understand what data we collect, how we use it, and your rights regarding your personal information.

You may access Tambu in the following ways:

• Free version: this gives you free access to a limited set of features.

• Free trial: you may be offered a free trial, which will give you free access to all available features for a specified period of time. If you do not cancel your subscription before the end of the free trial, you will begin a paid subscription.

• Paid subscription: this gives you full access to all available features for a fee. You will maintain access to all features for as long as you have an active subscription.

Subscription billing

Subscriptions may be on a monthly or yearly basis. You will be billed at the start of the billing period. Your subscription will auto-renew unless you cancel it. Tambu reserves the right to increase subscription fees. If subscription fees are increased, you will be given reasonable advance notice.

You can cancel your subscription through the Apple App Store or Google Play Store, whichever one you used to subscribe. Once you cancel your subscription, you will retain access to paid features until the end of your current billing period, and you will lose access after that billing period has ended.

Deleting your account will not automatically cancel your subscription. This is because subscriptions are managed by the Apple App Store and Google Play Store and we are not able to cancel a subscription on your behalf.

Subscription use

If you have an active subscription, you are entitled to access your account, including all paid features, on multiple devices for your own personal use. However, you may not share your account or allow others to use your subscription.

You retain ownership of the content you create and submit through Tambu, including your practice data, uploaded media, and any feedback or messages you send ("User Content"). By using Tambu, you grant us a non-exclusive, royalty-free, worldwide, transferable, and sub-licensable license to use, store, modify, adapt, publish, and create derivative works from your User Content for the purpose of providing, maintaining, and improving the app, including the development of new features or services.

This license includes the right for us to:

• Use your User Content to deliver the core functionalities of the app, such as storing practice data and analyzing your sessions.

• Analyze aggregated and anonymized data to improve Tambu’s features and functionality.

• Use feedback, suggestions, or ideas you provide to us (for example, feature requests) to develop new features, including premium features, without any obligation to compensate you for such use.

You are solely responsible for the content you upload via Tambu. By submitting User Content, you confirm that you have the rights to this content and that it does not violate the rights of others.

If you delete your account, your User Content will be removed from our systems, except where retention is required by law or as otherwise described in our Privacy Policy.

Tambu is designed for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any portion of Tambu or use of Tambu for any commercial purposes.

You agree not to use Tambu for any illegal or harmful purposes. This includes, but is not limited to:

• Engaging in activities that violate the rights of others or any applicable laws.

• Uploading any content that is abusive, hateful, discriminatory, or otherwise objectionable.

• Attempting to hack, reverse-engineer, or otherwise tamper with Tambu.

You also agree not to upload any pornographic material, sexually explicit content, or any content depicting sexual acts.

We reserve the right to terminate your account if you engage in any prohibited conduct.

We welcome feedback and suggestions to improve Tambu. You can provide feedback through the in-app "Feedback" feature.

If you choose to provide feedback, you grant Tambu the right to use, modify, and implement your feedback without any obligation to provide compensation, credit, royalty, or any other rights. Your feedback may be used to develop new features or improve existing ones, including premium features.

If you do not wish us to use your feedback under these terms, you should not submit your feedback.

Occasionally, Tambu may invite users to express interest in joining our Beta Users Group. This program offers early access to new features ("pre-release features") and the opportunity to help improve the app by providing feedback. Participation in the beta group is entirely voluntary and subject to the following terms:

• Registering interest: Users can express their interest in joining the beta group in their app settings. Expressing interest does not guarantee selection, as space in the beta group is limited. Only a small number of users will be invited to join at any given time.

• Providing Feedback: Beta users are encouraged to submit feedback through the in-app Feedback feature. Additionally, users may choose to join the Tambu Discord server to provide feedback and engage with other beta users. If you join the Discord server, you agree to follow our Code of Conduct, which prohibits discrimination, pornography, abusive behavior, harassment, and other inappropriate conduct.

• Access to Premium Features: Beta users will receive access to all premium features and pre-release features for free for a minimum of 6 months. After the initial 6 months, access to premium features will continue as long as the user has been and remains an active participant in the beta group. To be considered "active participants", beta users must submit at least one piece of feedback (e.g., bug report, suggestion, opinion, or feature request) every two months.

• App Stability and Reliability: Beta users understand that pre-release features are still under development and may contain bugs or other issues.

• Leaving the Program: Beta users can leave the program at any time by contacting us through the in-app Feedback feature or by emailing us at hello@tambu.fm. Upon leaving, users will no longer have access to premium and pre-release features.

• Removal from the Program: We reserve the right to remove users from the beta group at any time at our discretion. If a user is removed, they will retain access to premium features for at least 6 months from the start of their beta participation, unless they are removed for violating the Code of Conduct or engaging in other unacceptable behaviour.

We may release updates to Tambu at any time to improve functionality, add, modify or remove features. We are not obligated to maintain any particular feature or functionality, and you agree that we may modify the App at our discretion.

We reserve the right to terminate or suspend your access to Tambu at our discretion, without notice, if you violate these Terms or engage in prohibited conduct. If your account is terminated, you will lose access to all content stored in your account.

You may also choose to terminate your account at any time by deleting it within the app.

All content, features, and functionality provided by Tambu, including logos, designs, and trademarks, are the intellectual property of Tambu and its licensors. You are granted a limited, non-exclusive, non-transferable license to use Tambu for personal, non-commercial purposes. You may not copy, modify, distribute, or sell any part of Tambu.

Tambu is provided to you "as-is" and without warranty. We make no warranties, whether express or implied, regarding the reliability, availability, or suitability of Tambu for any particular purpose. You use Tambu at your own risk, and we disclaim all liability for any interruptions, errors, or loss of data.

To the maximum extent permitted by law, Tambu and its developers shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including loss of data, loss of content, or any other harm. Our total liability to you for any claims relating to Tambu shall not exceed the amount paid by you to Tambu in the 12 months prior to the date of the claim (if any).

You agree to indemnify, defend and hold Tambu harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, that arise from or relate to your improper use of the app, any content you submit (such as practice data, media uploads, or feedback), your breach of these Terms, your violation of data protection or privacy regulations, or your infringement of the rights of any third party. This indemnification covers any issues caused by your improper use of Tambu’s services or any violation of applicable laws or regulations.

This obligation to indemnify does not apply if the laws of your country do not permit such an agreement.

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you access or use Tambu from outside England and Wales, you are responsible for ensuring that your use complies with local laws and regulations. We make no representations or warranties that Tambu is appropriate or available for use in other locations.

We may update these Terms of Use or our Privacy Policy from time to time. We will notify you of any material changes through the App or via email. By continuing to use Tambu after changes are made, you agree to the revised Terms of Use and Privacy Policy.
